The charitable organization is an entity registered in Tanzania with the primary goal of enhancing the welfare of underserved communities by providing services such as free education, healthcare, infrastructure development or repair. Additionally, the organization holds a certificate from TRA recognizing it as a charitable organization.

 

Criteria for Qualifying as a Charitable Organisation for Tax Purposes

 

A charitable organisation is established to serve the public by relieving poverty or hardship, promoting education, providing free healthcare services, supplying clean water, or developing community infrastructure such as schools, health centres, roads, and water facilities. To qualify for tax purposes, the organisation must operate for the benefit of the public rather than to make a profit.

 

Its membership should be open to the public or to a specific group with a common charitable purpose, such as supporting widows, persons with disabilities, or children. The organisation must use its resources to serve the community and not for the personal or financial benefit of its members, directors, or founders. Any income or surplus it earns must be used solely to support and expand its charitable activities.

 

The organisation must have a valid ruling issued by the Commissioner confirming that it is recognised as a charitable organisation for tax purposes.

 

 

Application for Private Ruling to be Recognized as Charitable Organization

 

An application under this category should be submitted to the Regional Manager at the regional office where the organisation is registered and must be accompanied by the organisation’s registration status, constitution and performance report, an introduction letter from the District Commissioner of the area where the organisation operates, a copy of the organisation’s TIN certificate, and financial statements for the preceding three years.

It's crucial to understand that receiving charitable status from the Commissioner General does not inherently provide income tax exemption or exempt the organization from fulfilling tax return requirements.
