Clarification on tax exemption for deemed capital goods |

Following the decision of the Government during the 2009/10 budget to stop the practicing of categorizing certain goods deemed as capital goods which otherwise are not defined as such according to the Harmonized Customs tariff classification, there has been public concerns regarding the fate of the previously issued TIC Certificates and their related lists of goods approved to enjoy tax exemption as deemed capital goods.. We wish to clarify that the decision of the Government will affect only new investments that will be registered by the Tanzania Investment Centre (TIC) after 30th June 2009. The Tanzania Revenue Authority (TRA) will continue granting exemption to holders of certificates issued by TIC with the approved list of deemed capital goods prior to 1st July 2009, until the expiry of the implementation period of the respective projects. Therefore, the related approved lists of deemed/capital goods shall continue to enjoy tax exemption until the expiry of those Certificates. The procedure and criteria of approving the lists of tax exempted goods in respect of the previously issued TIC Certificates shall remain the same as they were before 30th June 2009.
